The trainer is facing a much lesser charge, maybe she knew nothing at all about it, could well be that Serge allegedly did this in the early morning darkness, cough, cough......

High profile racehorse trainer Kim Waugh will fight to clear her name on an animal cruelty charge after Racing NSW alleged she failed to prevent the use of illegal spurs on one of her racehorses.

Waugh, the wife of former Australian cricketer Mark Waugh, has been issued with three charges, including one for “failing to exercise reasonable care and/or supervision to the racehorse Tarsus to prevent an act of cruelty” in March this year.

Bush jockey Serg Lisnyy was charged with using spurs on the racehorse Tarsus “in a manner that mistreated the horse and resulted in Tarsus sustaining injuries to its off side flank region”.

Racing NSW claim the spurs were not blunt and not approved by the regulator.

Waugh is also facing charges for not reporting a suspected breach of the rules to Racing NSW and improper conduct towards an employee who reported the mistreatment of Tarsus.

Meanwhile, Racing NSW has also issued two charges against jockey agent John Walter for allegedly placing 26 bets on individual races in which his riders were engaged in. Walter is the former manager of top Sydney jockeys Tim Clark and Josh Parr, who have both joined forces with Tye Angland.

Outcome Of Stewards Inquiries And Charges Issued

Racing NSW Stewards provide the following release on recent inquiries conducted and charges issued.

Warwick Farm – 4 May 2021

1. Stewards conducted an inquiry into the conduct of several licensed person involving an assault and improper conduct. The results of that inquiry can be found in the attached Stewards report here.

2. Licensed stablehand Mr Daniel Mogus was disqualified for a period of 9 months for supplying and/or attempting to supply a substitute sample on 12 April 2021. The Stewards report is attached here.

Charges Issued – Jockey Serg Lisnyy & Trainer Kim Waugh

3. Racing NSW Stewards have issued the following charges against licensed jockey Mr Serg Lisnyy and licensed trainer Mrs Kim Waugh following a Stewards inquiry being conducted on 13 April 2021.

Mr Serg Lisnyy

• AR231(1)(a) – Committing an act of cruelty on the racehorse Tarsus on 20 March 2021, by using spurs on the racehorse Tarsus in a manner that mistreated the horse and resulted in Tarsus sustaining injuries to its off side flank region.
• AR125 – Using spurs on the racehorse Tarsus on 20 March 2021 which were not blunt and not approved by Racing NSW.
• AR134 - Using spurs on the racehorse Tarsus on 20 March 2021 in an excessive and/or improper manner.

Mrs Kim Waugh

• AR231(1)(b)(i) – Failing to exercise reasonable care and/or supervision to the racehorse Tarsus to prevent an act of cruelty on 20 March 2021.
• LR52 – Failing to report a suspected breach of the Rules of Racing in that Tarsus had been mistreated on 20 March 2021.
• AR228(b) – Improper conduct towards an employee who reported the mistreatment of the racehorse Tarsus to Racing NSW Stewards.

The hearing of the charges is scheduled to be conducted at 12pm on Thursday 20 May 2021 at the Offices of Racing NSW. 

Charges Issued – Mr John Walter

4. Licensed riders agent Mr John Walter has been issued with two charges under NSW LR71A for placing 26 individual bets on NSW races upon which riders he was a rider’s agent for held engagements in. 

The hearing of the charges is scheduled to be conducted on Tuesday 25 May 2021 at the Offices of Racing NSW.

Trainer, jockey to face serious welfare charges

Leading provincial trainer Kim Waugh will front the stewards later this month after being issued with three charges relating to allegations of “cruelty” on a horse she trains.

Waugh and jockey Serg Lisnyy were each issued with three charges following a stewards investigation conducted on April 13.

Lisnyy was charged with;

• AR231(1)(a) – Committing an act of cruelty on the racehorse Tarsus on 20 March 2021, by using spurs on the racehorse Tarsus in a manner that mistreated the horse and resulted in Tarsus sustaining injuries to its off side flank region.

• AR125 – Using spurs on the racehorse Tarsus on 20 March 2021 which were not blunt and not approved by Racing NSW.

• AR134 – Using spurs on the racehorse Tarsus on 20 March 2021 in an excessive and/or improper manner.

Waugh was charged with;

Meanwhile, Tim Clark and Josh Parr’s former manager John Walter has been issued with two charges under NSW local rule LR71A for placing 26 bets on NSW races where riders he managed were riding in.

In recent weeks both Clark and Parr joined forces with Tye Angland after leave Walter’s stable.

The hearing of Walter’s charges is set down for Tuesday May 25 at Racing NSW.

TRAINER KIM WAUGH TO FIGHT ANIMAL CRUELTY CHARGE

WHEN letsgohorseracing and peterprofit.com ran reports some time ago questioning why there had been no confirmation from stewards involving an alleged animal cruelty inquiry involving a top NSW trainer we were bagged left, right and centre as social media morons.

Although our sources were impeccable LGHR dropped off not only because we have the utmost respect for the trainer concerned but also we were reliably informed that this had been a set-up by an animal activist.

Sadly, the news has broken in the mainstream Sydney media that high-profile trainer Kim Waugh will fight an animal cruelty charge which alleges she failed to prevent the use of illegal spurs on one of her horses after being dobbed in by a stable employee.

FAIRFAX MEDIA reports that Waugh, the wife of former Australian cricketer Mark Waugh, has told close confidantes she will deny the accusation at a Racing NSW inquiry later this month. She has also been charged with failing to report the mistreatment as well as improper conduct towards the complainant.

Waugh and bush jockey Serg Lisnyy were both charged over the use of the spurs on maiden galloper Tarsus, which Racing NSW says “resulted in [the horse] sustaining injuries to its off side flank region”.

Racing NSW claims the spurs were not blunt and not approved by the regulator.

Fairfax has been told that Waugh, who has spent more than 30 years in the harness and thoroughbred industries without any welfare charges, did not attend the Wyong trackwork session in which Tarsus was said to have sustained the injuries.

She was believed to have spent the weekend away from the Central Coast farm she shares with her husband. The pair house several rescue animals on the property, which was inundated during the week-long NSW floods.

“I will be protesting my innocence and these charges are not good for business.”

Tarsus was sent to Wyong for a morning workout that weekend.

Lisnyy said he would also defend the three charges levelled against him, which include using the spurs in “an excessive and/or improper manner”.

 “I don’t think the charges are right,” he said. “They were normal spurs and similar to ones used by kids at pony club. I will be protesting my innocence and these charges are not good for business.”

Lisnyy has not been stood down from race riding and has been booked for rides at Newcastle, Mudgee and Quirindi from Saturday through to Monday.

Tarsus is yet to have an official race start, but stepped out for a first barrier trial on Wednesday at Newcastle and was beaten by 22 lengths. Lisnyy rode the horse in the heat.

Waugh has emerged as one of the state’s biggest non-metropolitan trainers in recent years and has been enjoying arguably the best season of her career with her horses winning $1.4 million in prize money in the 2020-21 campaign.

Animal welfare will be the catalyst that changes racing, the emerging generation [no matter what we boomers think of them] will be far more aware, thanks to social media.

This alleged act will be scrutinised and judged, but it's just the tip of the iceberg, Weir has now set a precedent his behaviour has alerted the media, relationships aside, we need truth and transparency with welfare issues and of course accountability.

If we can guarantee all horses have a cruelty free life both racing and beyond we will have succeeded, RNSW and RVL have at least attempted to get to first base, other states lag behind sadly, I have to trust that justice is served with this case and hope like hell we don't end up with another D Villella scenario.

Paul Perry-trained horses electrocuted in NJC stables accident


Two racehorses have been electrocuted in an accident at the Newcastle Jockey Club stables of veteran trainer Paul Perry on Friday morning at Broadmeadow.

NJC chief executive Matt Benson said the "freak accident" at the Newcastle Racecourse stables was believed to have been caused by rodents which had chewed through an electrical cable, causing a livewire to touch the back of the metal frame of stables.

Mr Benson said it was believed the horses died when they touched the stalls after they were put back in following morning trackwork.

Mr Benson rejected reports that other horses were injured and staff were advised to go to hospital.

He said people at the scene were understandably distressed but none were injured.

He had been in contract with the Perry team.

"They were obviously devastated and the whole thing was a horrible accident you just don't expect to happen," he said.

He said SafeWork NSW had been on site to investigate the accident.

IMO it's too delicate a subject to lay blame........accident, yes, negligence, maybe......many stables are death traps, most of us have worked in those, sheer good luck nothing like this happened to me, if they were in disrepair those stables, but lessons are learned, something good might come of this, hopefully those poor souls haven't died in vain.......NJC might bring in a Quality Standard or similar.......let's see.

Even our very best trainers seem to have very dirty looking stables.

Do Australian trainers do things on the cheap ?

I know it reads like me having another cheap shot at our trainers but it is a genuine question.

Some lovely stables I have seen in my life time have been bulldozed for units , older English style overhead lofts , pergola like like sand rolls with roof and covered in lovely vegetation , the walls out at a 15 degree angle to stop horses whacking their hips or joints when taking the " ginger" out of them , I was with the stable that was the first to move to the high street built up on the hill at Randwick 62/63 they were clean , brick , lovely lawn courtyard , and the amenities for staff superb .

As far as I know the stables are still serving well on High street , Fred Alsop was the first it was named Connaught Lodge after his Epsom winner mid fifties , then Pat Murray , pretty sure his was Tails Lodge , Dick Roden next , then Les Bridge who no doubt is still there today and going great guns. Wink

Fred Alsop's daughter Lesley married Bill Picken Carioca, who went on to become Chairman STC.....she could train a horse too, lovely stables out at Rosehill, now about 60 apartments on that lot. How times have changed.

Very true Bonjour , Leslie was a little " tom boy " when I knew her , lovely kid with great smile and very much into horses , totally different to her sister who I thought so much like her mum , Fred trained for some high profile men on or very close to the AJC. Com. so always had a stable full , I was apprenticed to him in / 58 , left after 1 year ( bad tempered ) went to McCarton.
