Have a look at the list of US Supreme Court judges, or some of the Judicial appointments at State and Federal level in Oz, and see if you still reckon they're the go.

So far as I am aware, Pell didn't have the option of choosing between a jury or a judge, at the time. I think the preference for a judge(s) only trial, is well founded, for an innocent person, too many people on juries are too ready to convict, on too little evidence, just as they are in daily life.

Melbourne Cup-winning trainer Darren Weir will face trial later this year after a video link directions hearing in the County Court on Friday morning set a date for the high-profile case to be heard. Weir and his co-accused, Jarrod McLean and Tyson Kermond, are due to front the Ballarat County Court on October 31, which ironically is Melbourne Cup eve, on charges relating to animal cruelty and conspiring to cheat. It's understood lawyers for the three defendants are seeking a severance of some of the charges so they can be heard separately. The trial is expected to last around three weeks. |

Conspiracy charges dropped against Darren Weir, Jarrod McLeanProsecutors have dropped conspiracy charges against former Warrnambool horse trainer Jarrod McLean and Melbourne Cup-winning trainer Darren Weir. The pair was due to stand trial during the week of the 2022 Melbourne Cup after pleading not guilty to a conspiracy charge. Weir and McLean were accused of conspiring to cheat and defraud Racing Victoria officials over an illegal training regime they allegedly used on racehorses Red Cardinal, Yogi and Tosen Basil in the weeks before the 2018 Melbourne Cup. It had been alleged the offending occurred between October 24 and November 17, 2018. But on Friday (October 28) during a pre-trial hearing the Office of Public Prosecutions filed a notice of discontinuance in the Melbourne County Court. A prosecutor said the matter had been resolved and the notice cleared the conspiracy charge on the indictment. She said that left charges relating to alleged corrupt betting and animal cruelty, which were downgraded to the magistrates court. Police previously alleged the men took part in conduct that tortured, abused, overworked and terrified the horses and caused them unreasonable pain and suffering. Weir also faces a charge of possessing a firearm and McLean a charge of possessing a drug of dependence. All matters were transferred to the Warrnambool Magistrates Court, where the two men are now due to appear on December 14. Earlier this week the conspiracy charge was also dropped against McLean's former stable hand Tyson Kermond. Judge Paul Lacava thanked all parties for coming to a resolution, which he said would ease an "ever-increasing backlog" and save a considerable amount of court time. The Standard contacted barrister Ian Hill KC, representing Weir, declined to comment. |

I agree Rusty, the No 1 charge brings gaol time, the others don't, well they do if the maximum is imposed but with a possible plea bargain [alleged] that may well be negated.......now the door's open to the ''greatest trainer that ever walked' to make a Lazarus return to the training ranks, and earlier than thought with time served......maybe........Oh glory be.

How does a man that treated horses like that, a majestic animal that provided him with an affluent revered lifestyle, gained him the respect of horsemen and race lovers world wide, EVER be allowed to have horses under his care once again?
I, like many, admired him for his talent and what I thought was real love of horses. But no......... Police previously alleged the men took part in conduct that tortured, abused, overworked and terrified the horses and caused them unreasonable pain and suffering.

Well if he gets his licence back in 23/24 season lets see what type of person plies him with their horses? The mind boggles, an owner looking for a edge perhaps, or a greedy bastard with a win at all costs mentality, whatever it takes types.......and they're out there alright.

Bonjour is on the right track. Anybody who supports cheats is no better themselves. But all roads seem to lead back to the same stable supporters. Punters, money laundering of criminal enterprises, underworld figures. There seems to be an unwillingness from Industry officials to scrutinise or make it difficult for these people to operate in the game without providing background details. Much like the large sale companies who treat Damion Flower and co like rock stars.
The small owners who used to have one horse racing are disappearing.

Darren Weir âvery keen to returnâ to racing, but faces cruelty charge and character testA host of disqualified racehorse trainer Darren Weirâs former clients are ready to support the Melbourne Cup winnerâs return to racing, should Racing Victoria grant him a new licence in 2023, including multiple group 1 winner Nature Stripâs owner Rod Lyons. But Racing Victoriaâs stringent character testremains in the way of Weirâs return. Late last month, conspiracy charges against Weir and co-accused Jarrod McLean were dropped by prosecutors as part of a plea deal which saw allegations of animal cruelty and corrupt betting downgraded, to be heard next month in the Warrnambool Magistrates Court. A source close to the case said Weir is expected to plead guilty to using a âjiggerâ on gallopers Yogi, Red Cardinal and Tosen Basil while they ran on a treadmill at his Warrnambool stables just days out from the 2018 Melbourne Cup carnival. Weirâs four-year disqualification from racing for possession of electric shock devices expires on February 6, 2023, by which point Weir will be allowed to reapply for his licence. Weirâs lawyer Tony Hargreaves told The Age that the 2015 Melbourne Cup-winning trainer âhopes to return to horse racingâ once next monthâs court proceedings have concluded. âTraining racehorses has been a very important part of Darrenâs life, and heâs very keen to resume it,â Hargreaves said. But Weir will have to pass Racing Victoriaâs strict character test, which will determine whether the 52-year-old is a fit and proper person to hold a training licence. The closest precedent to Weirâs case is that of Horsham trainer Paul Preusker, who was ousted from racing in 2007 for four years for possessing and being party to the use of a jigger. Preusker has since returned to racing, and trained the group 1 win of Lunar Fox in last yearâs Australian Guineas. But judge John Bowman, who handed down Weirâs four-year ban in 2019 in the Racing Appeals and Disciplinary board, said of that precedent at the time of Weirâs ban: âThe emphasis on animal welfare is now even greater than it may have been 12 years ago. âWhen dealing with Mr Paul Preusker, licensed trainer, on a charge of both possessing and using a jigger back in early 2007, the Board referred to the practice, possession and use of jiggers as being abhorrent, and a practice that tarnishes the image of the racing industry,â judge Bowman said. âIt is still abhorrent.â Racing Victoria did not have its character test in place when Preusker regained his licence. Racing Victoria has since declined licence applications from former Aquanita trainer Stuart Webb, as well as former trainer Mark Riley, who had been disqualified for three years for TCO2 doping and had a history littered with prior racing offences. Former jockey Danny Nikolic has also had licensing applications rejected by Racing Victoria under the policy. The character test considers an applicantâs record of compliance with the Rules of Racing, whether an applicant has been candid and cooperative in all dealings with racing authorities and whether they had been the subject of an adverse finding by a judge in any civil proceedings. Weir did not contest the Racing Victoria charges, and those close to him say heâs extremely remorseful, and has been intent on maintaining a low profile throughout his disqualification. Respected trainer Mick Price said his peers could be split on whether the four-year ban was sufficient for Weirâs actions. âI would think itâs up to racing admin to measure the application [when itâs submitted],â Price said. âThere is definitely a thing which says, âyou do the crime, you do the timeâ, and I suppose itâll be a matter of opinion whether the time was enough or not. I would think four years on the outer for a bloke like Darren Weir is severe.â Weir has a host of owners willing to help him re-establish his training business if Racing Victoria were to grant him a new licence. They include Australian Bloodstockâs Jamie Lovett, OTI Racingâs Terry Henderson, and Lyons, whose star sprinter Nature Strip was trained by Weir at the time of his suspension. âHeâs done his time, he did the wrong thing, heâs made no big song and dance and like anybody, when your timeâs over youâre entitled to have another chance and our syndicate would have no hesitation in sending him horses, and we would send him horses if he got his licence back,â Lyons said. Henderson echoed Lyonsâ sentiments. âDarren is one of the best horsemen Iâve ever known, and I would welcome his return to training,â he said. Weir had more than 600 horses on his books when his suspension was handed down in 2019, and employed 150 staff in his stables. For Gods sake, no-one condones what Preusker did, but this low life was hitting horses up [allegedly] on a treadmill in a confined space, I'll do it to you, see if you like it, the horses would have been terrorised, I want to know how many times he did it, in one session, then you might rescind your comment.
