Yes it’s a condition to not have horses whilst serving but that doesn’t get rid of issues of real or perceived conflicts of interest

Leading trainer Darren Weir has been disqualified by the Racing Appeals and Disciplinary Board for four years.

The 48-year-old appeared at the Wednesday morning hearing, supported by legal representative Patrick Wheelahan, but didn't speak, with the RAD Board requiring two-and-a-half hours before delivering their verdict.

Racing Victoria stewards had recommended a four-year period of disqualification for Weir after Monday's show cause hearing, which lasted more than 11 hours.

Weir, through Wheelahan, offered a plea of 'no contest' to four charges, three of them relating to the possession of an electronic apparatus on his licensed premises, and the other for conduct prejudicial to the image of racing.

Consequently the three-man RAD Board panel of judges, led by Chairman John Bowman, required little time to agree that the charges were proven.

Therefore the focus turned to the matter of penalty.

RV legal counsel Jeff Gleeson, SC, told the RAD Board that the recommended four-year penalty should be maintained.

Gleeson said that electronic devices 'damage the image of racing' and 'places winning ahead of the welfare of the horse'.

The RAD Board heard how trainer Paul Presuker received a two-and-a-half year penalty for possession of an electronic device in March 2007.

However, Gleeson reaffirmed that Weir is 'an industry leader' and therefore carries the 'benefit and burden' of holding that title.

In making a penalty submission on behalf of Weir, Wheelahan said that the leading trainer had cooperated willingly over the past week since his stables were raided.

"He has seen other matters take years and cost millions to the industry," Wheelahan said.

Bowman, along with fellow RAD Board judges Joshua Bernstein and Brian Forrest, then retired to consider the penalty submissions before agreeing with the recommended four-year disqualification period.

Weir exits the training ranks at the top of Melbourne's training premiership for the 2018/19 season with 93 wins, 61 victories clear of David, Ben Hayes and Tom Dabernig, who were his nearest rivals.

Weir has won 243 Victorian races since the start of the season in August, meaning he's trained double the amount of winners compared to the Hayes and Dabernig training trio, who have accumulated 119 wins.

The steady stream of horses exiting Weir's Ballarat and Warrnambool properties will continue in light of Wednesday's verdict.

Weir, who holds part-ownership of numerous horses, must divest himself of any interest in a registered horse, prior to that horse being permitted to accept for any race with another trainer.

So ...
RV and police have both stated they do not have video evidence of jiggers being used on horses.
McLean claims his was a legal cattle prod, found at his home, where he keeps cows.
The other 3 were found in Weiry's bedroom. (ahem )

Terrible form which simply indicates the lack of insight that this bloke has into the way things work.

Not everyone starts with a deep-pocketed fisherman like Tony Muollo, and gets a start at Rosehill from the beginning, like Waller did. Nor does everyone get the opportunity to ride on the coattails of family. It’s very tough working one’s way up from the bottom in this industry, in part due to the attitude displayed above. There are no doubt some ordinary small trainers (as there are ordinary big trainers) but it is very difficult to discern the ability of a trainer or horseman just by looking at stats.

You clearly have absolutely no idea about Waller's start in racing in Sydney, let alone in NZ. To suggest the man had any advantage in terms of backing is hilarious if it wasn't disrespectful.

I'm a well-documented (on here), long-time admirer of Waller - mostly because I have observed his career including where it started at Rosehill. But I'm no one-eyed groupie and would not recommend him as a trainer in many circumstances for various reasons.

However I can tell you he did not have any owner of substance at any early stage. And even when he did start to gain traction through his results and wealthy owners started to get behind him, it was in the form of Gerry Harvey giving him horses he couldn't sell that were bred ordinarily, or Tubby Turner giving him the odd thing he couldn't sell in QLD.

The man is completely self-made. Rumour what you like about what he does these days and whether you believe his horses are clean. No one can speculate in this day and age. But fact is fact and he simply did not get a head start with strong backing of owners.

It's often been said that a week is a long time in racing, as Darren Weir can now truly attest.

Last Wednesday morning, at the break of dawn, Weir's stables at Ballarat and Warrnambool were raided.

And just seven days later the 48-year-old trainer would be sent into exile from racing, an industry he ruled with ever-increasing dominance across Australia, for four years.

Racing Appeals and Disciplinary Board Chairman Judge John Bowman and fellow Judge Brian Forrest believed a four-year disqualification period was adequate while Judge Joshua Bernstein wished to impose a five-year disqualification.

And it was when Bowman, who spoke on behalf of Forrest, delivered the reasons for arriving at a four-year disqualification as a suitable penalty that the Weir facade cracked.

"It's sad for it to have come to this," Bowman said ruefully as a bright, red-faced Weir leant forward gazing towards the carpet, wiping his eyes.

Weir was seated in the front row of the hearing room, alongside his legal representative Patrick Wheelahan, who had done all the talking for his client through the two-and-a-half-hour hearing.

Bowman continued: "The rags to riches story, starting from Berriwillock…"

By now it was as if the enormity of the situation had hit Weir as he struggled to hold his emotions together.

"All of this makes your fall even more sadder," Bowman said.

"Now you will be remembered for possessing instruments of cruelty and instruments associated with high-level cheating."

Bowman described Weir's possession of electronic apparatuses as 'abhorrent', consistent with comments made by the presiding judge in the case of trainer Paul Presuker when he was penalised for possession and use of a similar instrument in 2007.

"The practice is still abhorrent and the emphasis on animal welfare is greater than 12 years ago," Bowman said.

Weir's Ballarat property was raided at 6:05am last Wednesday and 35 minutes into the search, three 'jiggers' were located in his master bedroom.

Bowman said that the jiggers being discovered in the master bedroom couldn't 'infer inadvertence'.

"It suggests personal knowledge and a desire to conceal," Bowman said.

Bernstein believed that although stewards and Weir had reached a common position in penalty, that a period of five years disqualification should be served.

Bernstein believed Weir should have received a two-and-a-half-year penalty for the three charges of possessing an electric apparatus and another two-and-a-half-year year penalty, to be served cumulatively, on the charge of conduct prejudicial to the image of racing.

"The damage to the image of racing has been enormous," Bernstein said.

"It's of the most serious nature and the punishment must be accordingly."

The fact the majority of RAD Board judges believed four years, rather than five, was a suitable period of disqualification provided Weir with scant consolation.

The difference of 12 months in penalty won't restore Weir's tattered reputation.

Nor will the memories of past glories, 36 Group 1 victories among them, with the Melbourne Cup victory of 2015 with Prince Of Penzance the biggest of them all.

And with a police investigation pending, it may not be the last time Weir is sighted before the RAD Board during 2019.

It was in the 1st police press conference after the raids. They said they knew of rumours about videos, but didn't have any such evidence.

(And despite the seriousness of the whole situation, I'm glad I'm not the only one here who thought jiggers in his bedroom was funny!)

Stier said stewards were aware of the reports and also the rumours that had been circulating - but revealed stewards were not in possession of video showing any alleged wrongdoing from Weir.

“We don’t have video here at this time that has been referred to,” Stier told Melbourne radio RSN on Tuesday morning.

The man is completely self-made. Rumour what you like about what he does these days and whether you believe his horses are clean. No one can speculate in this day and age. But fact is fact and he simply did not get a head start with strong backing of owners.

Why did he re-hire Prior Sunline?.....after what he did to his owners? what a bloody disgrace. It's just not ethical.
