Salim Mehajer behind bars over car crash before scheduled court appearance

Updated 5 minutes ago

Former Auburn deputy mayor Salim Mehajer will spend tonight in custody after being formally refused bail over charges relating to a car crash that happened on his way to court for an alleged assault.

Police arrested Mr Mehajer and his business associate Ahmed Jaghbir, 28, along with four others over what police allege was a staged car crash.

Mr Mehajer, 31, was on his way to court at the time of the crash last year to face charges over the alleged assault of a taxi driver.

The October 16 car crash took place at the intersection of Nicholas and Delhi Streets, Lidcombe, between Mr Mehajer's Mercedes AMG and a Mitsubishi Outlander.

After the collision, Mr Mehajer was treated by paramedics in full view of television cameras and was taken by ambulance to Westmead Hospital.

Although his lawyer Brett Galloway said his client had been a passenger in the car that crashed, vision from the scene showed Mr Mehajer being removed from the driver's seat of the Mercedes SUV.

It is alleged Mr Mehajer planned the crash to avoid court and commit insurance fraud.

When asked if it was an extreme method for a person to use to avoid court, Detective Superintendent Philip Rogerson said: "It is … but the evidence we've gleaned is … sufficient to put before the court."

He said the crash "was not acceptable".

"It's not acceptable to the police, and in particular, the emergency services that freed them on that particular day, out of that car, and obviously, the insurance companies and people like yourselves who have to pay your premiums."

Just before 7:00am today, detectives arrested Mr Mehajer at his new home at Vaucluse and he was then charged with perverting the course of justice and conspiracy to cheat and defraud.

Police will allege in court the group conspired before and after the incident and provided fraudulent versions of events to investigators and insurance companies.

Mr Mehajer has been remanded in custody ahead of a court appearance tomorrow after a Waverley local court magistrate deferred a decision on whether to grant bail today.

The lawyer for Mr Mehajer told the court his client was not a flight risk, but police said his alleged crimes were escalating in seriousness.

More charges likely.....

Salim Mehajer to remain behind bars after magistrate refuses bail

Lisa Visentin

Published: January 24 2018 - 11:48AM

Controversial Sydney businessman Salim Mehajer will remain behind bars after a magistrate denied him bail.

The 31-year-old had applied for bail at Waverley Local Court on Tuesday after being accused of staging a car crash last year to avoid going to court for a separate matter.

But magistrate Jennifer Giles on Wednesday refused his application, saying he had not shown cause as to why his detention was unjustified.

Calling it a "mad idea", magistrate Giles poured cold water on Mr Mehajer's claim that he had been the victim of an extortion scheme by the occupants of the other car involved in the crash.

Ms Giles said family members of the other driver were allegedly heard later in telephone intercepts to be claiming $10,000, saying they had helped Mr Mehajer.

Furthermore, she rejected the claim by Mr Mehajer's lawyer Tom Hughes that the case against Mr Mehajer was circumstantial and weak, finding instead "the strands of the prosecution case to be quite damning".

Mr Mehajer was behind the wheel of his Mercedes AMG on the way to court on October 16 when his car was involved in a crash with a Mitsubishi Outlander on Delhi Street in Lidcombe about 8.40am.

He was taken to hospital, while his passenger and the occupants of the other vehicle - two women aged 31 and 32 - were uninjured.

The other driver admitted fault after the crash, the court heard on Wednesday.

Police allege Mr Mehajer, the former deputy mayor of Auburn council, was part of a joint criminal enterprise with five other people to set up the crash, including Ahmed Jaghbir, an electrician and business associate who was later charged with an unrelated murder.

Mr Jaghbir allegedly said he was instructed to arrange the October collision to buy Mr Mehajer some more time before his scheduled court hearing that day, the court heard.

Mr Mehajer was arrested on Tuesday and charged with perverting the course of justice and conspiring to cheat or defraud over the crash.

The court heard on Tuesday that Mr Mehajer took out an insurance policy on the car for $156,000 nine days before the crash, and his family lodged a claim on that insurance on the day of the crash.

Speaking outside court, Mr Hughes said he anticipated he would receive instructions from Mr Mehajer to make a further bail application in the Supreme Court.

"Let's wait and see what the evidence shows," Mr Hughes said.

"There is no admission made by Mr Mehajer. There is no attribution to Mr Mehajer of any direct involvement by way of surveillance device, telephone intercept or any other product that's been provided to us at this stage."

Ms Giles adjourned the case until March 28.

Salim Mehajer's solicitor withdraws from case over 'untenable position'

Updated about 5 hours ago

A prosecutor has asked a magistrate to take the words of Salim Mehajer with "a very, very large grain of salt" after the former deputy mayor of Auburn asked for his assault hearing to be adjourned.

Mr Mehajer, 31, has pleaded not guilty to assaulting a taxi driver and stealing his eftpos machine and phone near the Star Casino in April last year.

After eight nights in prison, a tired and drawn looking Mr Mehajer arrived at the Downing Centre Local Court this morning for a two-day hearing.

However, before it could begin solicitor Brett Galloway withdrew from the case, telling Magistrate Vivien Swain he had been asked to take a position which was "untenable".

Magistrate Swain asked Mr Mehajer if he would be representing himself, to which he replied he would like an adjournment to organise new legal representation.

The property developer said a court order freezing his funds had meant he had been unable to pay his lawyers.more....
