Paul Murray: Bill Shorten flags untrustworthiness with hypocrisy on penalty rates

Judicial independence is a bit like pregnancy. And, as the old saying goes, you can’t be a little bit pregnant.

When the Rudd Labor government decided to appease the unions by putting industrial arbitration under the aegis of a Fair Work Commission of its own design, it reassuringly stressed it would be independent.

It also decided in 2009 that as part of its new charter, the commission would every four years review what are known as modern awards, the legal framework under which many workers are employed.

Now the employment minister who did this was a former union leader called Bill Shorten.

When it came time for the commission to do the first of its reviews in 2010, Shorten directed it should include penalty rates, even though that had not been the tribunal’s original intention.

Industrial relations moves at a snail’s pace. Time flies.

After rolling two Labor leaders, losing power and eventually rising to the top to head the Opposition, Shorten was fighting to win government in 2016 as the review drew to a close under the coalition.

Asked by 3AW’s Neil Mitchell what would happen if the commission cut Sunday penalty rates, Shorten was unequivocal.

“I’ve said I’ll accept the independent tribunal,” he said on April 20, 2016.

“I’ve got my opinion. At the end of the day though, the way minimum wages get set in this country is through evidence, it’s through the submissions of workers, their representatives and employers.”

Now, it should be noted that the Federal coalition government did not make a submission to the review.

So there can be no suggestion that the coalition had a hand in the decision of the “independent” tribunal.

Shorten lost the Federal election in July 2016, but when the FWC came down with its review decision the following February to reduce penalty rates for some employees on Sundays and public holidays, he completely changed his tune.

I am indebted to industrial lawyer David Bates for detailing the Labor leader’s messy history on this matter:

“On the night of the commission’s decision, Mr Shorten invited a young retail worker to front the cameras and explain how ‘gutted’ he was by the commission’s decision.

“The only problem was that the young man works for Coles and is covered by an enterprise agreement. As a result, the commission’s decision actually doesn’t impact him at all. #oops

The enterprise agreement which covered the young man in question was negotiated between the SDA (the militant retail union) and Coles. And guess what? That agreement had long ago reduced penalty rates to below the Modern Award rates.

“Put another way, the union had already cut penalty rates for precisely the same employees they now claim will be devastated by the commission’s decision to do exactly the same thing. Now that’s embarrassing.”

There have been media reports that Labor intends to flick the switch to penalty rates this week after the post-Budget Medicare cancer policy fell somewhat flat.

The Liberals should be licking their lips. This issue demonstrates Shorten’s untrustworthiness and lack of credibility better than any other.

Perhaps the Coalition could dig up the clips of leftist idol Waleed Aly reminding Shorten he was a hypocrite on penalty rates in March 2017 after his flip-flop.

“You’ve said this is the Government’s assault on workers,” Aly said on Channel 10’s The Project.

“They’ve said you’re a hypocrite because you helped bring the Fair Work Act into being and you have to own this decision. It seems like they are making a fair point?”

Shorten responded: “No, not at all. The penalty rates changes the Fair Work Commission has made are due to initiation by employers to lower penalty rates.

“The issue here is the Government can step in and change the decision, which is cutting penalty rates, but they’re sitting on their hands. If they sit on their hands they’re supporting the cuts.”

Then Aly struck: “To paraphrase, I will accept the independent umpire’s decision, unless they make a decision I don’t like?”

Labor’s election advertising claiming the Coalition voted on a number of occasions to cut penalty rates is highly misleading.

The Coalition Government did not need to legislate the FWC cuts.

What happened is that Labor moved symbolic motions opposing the cuts and the Coalition, believing in the promised independence of the commission, rejected them.

Shorten and his union bosses need to be confronted with the truth.

Shorten ‘was being polite to worker’

Opposition workplace relations spokesman Brendan O’Connor says Bill Shorten was “being courteous” and “polite” by telling a high income worker that Labor would look at tax breaks for those earning more than $200,000 a year.

Mr O’Connor today rejected suggestions Labor was focused on tax breaks for those on higher incomes despite Mr Shorten’s pledge yesterday to examine the issue when asked by a coal export terminal worker in Gladstone.

He instead played down the remark by Mr Shorten, saying the Opposition Leader was making polite conversation.

“Frankly it’s not our priority worrying about someone who is on $250,000 a year,” Mr O’Connor told the Macquarie Media radio network.

Mr O’Connor rang in to the radio network to provide some short “grabs” on Labor’s casual conversion policy, but became stroppy when asked about Mr Shorten’s pledge to the coal export terminal worker.

“I think Bill was being courteous to a worker … I think Bill was being very kind, polite. I was there by the way,” Mr O’Connor said.

“If you are earning $200,000 a year, it’s not our priority … If you’re working hard and you’re making that sort of money, good on you.
