Child sex-accused swim instructor Kyle Daniels kept job despite complaint, court told

A swimming instructor charged with more than 30 child sex offences was allegedly allowed to remain in the job despite a complaint being made against him nine months earlier, a Sydney court has heard.

Kyle Daniels, 20, is accused of molesting eight girls — aged between six and 10 — while coaching them at a Sydney swimming centre between June 2018 and March 2019.

Last month he was arrested at his Balgowlah home after the parents of two sisters contacted police about allegations of inappropriate touching and sexual assault.

After being questioned at Manly Police Station he was charged with three child sex offences, but today, 28 additional charges were laid against him following an extensive investigation.

According to a statement by police, the charges include eight counts of sexual intercourse with a child under 10, six counts of intentionally sexually touching a child under 10 years and 14 counts of indecent assault of a person under 16 years of age.

The court was told the complaint nine months ago related to inappropriate behaviour.

The Sydney University student, who is studying sports psychology, smiled at his mother as she mouthed "I love you" at the start of the bail hearing at Manly Local Court today.

In arguing for his release, defence barrister Todd Alexis told the court allegations of "inappropriate touching" may have "happened by accident" and were a "misunderstanding".

"It is highly likely that what she (one of the girls) felt was her swimming costume riding up during backstroke — and also given that other parents and staff were around at the time the alleged inappropriate touching was committed," he said.

"He strongly denies the allegations — that any of the touching of these young girls was sexual in any way whatsoever."

Mr Alexis referred to several "good character" references provided by female friends of the accused, to which Magistrate Daniel Reiss replied, "we have a cardinal (referring to George Pell) now in jail — that was improbable".

Court told of 'serious abuse of trust'

The police prosecutor argued it was not "highly unusual to have matters like this committed by people of good character".

"Those children were all in a situation where the applicant held some authority over them — serious abuses of trust and authority invested in him," he said.

Mr Daniels has already spent a week in jail, and during that time, the court heard how he was subjected to death threats after a prison guard read out the charges in front of other inmates.

The Knox Grammar School graduate smiled while his mother, father and twin brother mouthed the words "yes" when he was granted bail at Manly Local Court today.

In granting his release, Magistrate Reiss said he was satisfied community safety concerns regarding the accused could be mitigated with strict bail conditions.

Mr Daniels will have to live at home with his parents on Sydney's northern beaches, surrender his passport, report daily to police, agree not work or go anywhere near children under the age of 16.

He will also have to provide a $100,000 surety.

Mr Daniels worked at the swimming centre for two years, but was suspended before his arrest.

He is due to face court again in May.

Bring back the death penalty, but I'm sure a few will defend him saying he is a good citizen
