ACT's former top prosecutor Shane Drumgold successfully challenges findings of inquiry into Bruce Lehrmann prosecution

  • In short: Former ACT director of public prosecutions Shane Drumgold has succeeded in challenging some adverse findings made against him in the final report of a board of inquiry into the prosecution of Bruce Lehrmann.
  • Acting Supreme Court Justice Stephen Kaye ruled inquiry head Walter Sofronoff's communications with journalist Janet Albrechtsen could lead a fair-minded observer to conclude she impacted his views.
  • What's next? Acting Justice Kaye is expected to hear further arguments this afternoon over what relief Mr Drumgold is entitled to.

Re Mr Drumgold - I am not sure what he will end up with. However, I cannot see him getting his job back considering his admission of withholding evidence from the Defence. That's a no, no.

Sofronoff's shenanigans had nothing to do with that. 

Might end up with a few bob like Linda maybe

Judging for Dummies - When may a judge talk to the press?

A: The Model Code does not expressly prohibit a judge from speaking with the press. Judges may speak with the press at any time—but not about any matter.

Educating the press and the public about the judicial process is always OK.

But judges should avoid speaking to the press or making any “public statement that might reasonably be expected to affect the outcome or impair the fairness of a matter pending or impending in any court … or might substantially interfere with a fair trial or hearing” (Rule 2.10). Translation: Don’t comment on a trial that is in progress or about to start, whether or not it’s your trial.

Justice Kaye said he reviewed 77 articles and that it was “clear that Ms Albrechtsen consistently expressed views that were particularly critical of the plaintiff”.

Dan O’Gorman, SC, for Mr Drumgold, told the court Mr Sofronoff had “never initiated contact with any other journalists”.

Justice Kaye said “a fair-minded observer would regard the volume, and frequency, of those communications [with Mr Sofronoff] as a matter of concern” – particularly when other members of the media were going through the board.

“The vast majority of those communications with Ms Albrechtsen took place in circumstances in which it would appear that Ms Albrechtsen contacted Mr Sofronoff.

“Nevertheless, a fair-minded observer would regard the volume, and frequency, of those communications as a matter of concern.

“In particular, the fair-minded observer would consider it significant that Ms Albrechtsen communicated with Mr Sofronoff on so many occasions, in circumstances in which other members of the media were adhering to the protocols to which I have referred.

“Further, the frequency with which the communications took place would, have raised an apprehension, on behalf of the fair-minded observer, that the content of them might well have gone beyond requests, by Ms Albrechtsen, for information. “

Also hearing the latest defamation case re Miss Reynolds has been delayed - waiting for the Brucey defamation case outcome first

David & Brit need to stay around a bit longer than they wanted

Must be horrific for Miss Reynolds to be put through all this delay. Traumatising having to relive those comments daily

As I said that is the normal process for defamation. Mediation is attempted and if unsuccessful advances to trial. Most cases are resolved before trial but sometimes when both parties are determined to not concede any ground or apologize it goes to trial.
