Brexit: shutting down parliament 'gravest abuse of power in living memory'

Exclusive: legal advice states action to force no-deal Brexit would be open to court battle

Boris Johnson would be committing the “gravest abuse of power and attack on UK constitutional principle in living memory” if he shuts down parliament to help force through a no-deal Brexit, according to legal advice obtained by Labour.

In a six-page document prepared for Jeremy Corbyn, the shadow attorney general, Shami Chakrabarti, laid out how any such move by the prime minister would be open to immediate legal challenge in the courts.

She said it could be subject to judicial review and the courts “might well even grant interim injunctive relief in order to allow both houses of parliament to continue to sit and discharge their primary and sovereign constitutional role in this current moment of national crisis”. more...

Boris Johnson set to suspend parliament in bid to force through no-deal, reports say

  • Benjamin KentishPolitical Correspondent @Boris Johnson will ask the Queen to suspend parliament from mid-September until just two weeks before the 31 October deadline, reports suggest.

    The explosive move will be seen as an attempt to stop MPs from blocking the prime minister forcing through a no-deal Brexit.

    Under government plans, parliament would be suspended days after MPs return from their summer recess next week and would only return for a Queen's Speech on 14 October, according to the BBC.

  • The BBC suggested that parliament would not sit from 10 October, meaning there would be just a week between MPs returning from their summer break and the suspension beginning.

  • It means there would be barely any time for parliament to pass legislation blocking a no-deal Brexit if Boris Johnson fails to secure a fresh agreement with the EU.​​

    Proroguing parliament has been mooted for months but is seen as a hugely controversial, given it would effectively sideline MPs and peers during a time of potential national crisis. 

    A group of MPs launched a legal bid earlier in the summer to stop Mr Johnson proroguing parliament, but the government is likely to claim that the move is normal procedure ahead of a Queen's Speech. Normally parliament does not sit for several days before the event, which marks the start of the parliamentary sitting.

Things should start to heat up from tomorrow and every option is on the table at the end of the 5 week prorogation, from a clean deal passed through parliament(very long odds) to a hard exit, a general election and strife returning the Irish border. A great deal is riding on the next 2 month, including the future of the EU if they weaken.

We now have a UK government that can’t/won’t say a simple ‘yes’ to the question ‘will you abide by the law?’ Not so much prorogue as just plain rogue. These are dangerous times for democracy. We mustn’t allow this behaviour to be normalised.

In response to Michael Gove being asked on BBC if the Govt would honour a law passed by both houses this week to delay Brexit. He refused to answer.

Prorogation will not force Europe into a deal as Mr Hodges suggests.

Europe need the backstop and I cant see why they would give up on it.

The only attempted coup and threats are being made are by Nigel Farage who is holding a knife at Johnson's throat for a hard no deal break.

Boris lost control of his own govt today with conservative MPs crossing the floor to vote with the opposition parties, taking control of the legislative order.

Tomorrow they will vote on and pass a law to block a ''No Deal'' Brexit that slimy Boris is trying to get away with. 

Boris will now have to abide by that new law or go to an early election, likely to be called for mid October.


Theresa May is clearly shattered for poor Boris.

Cameron backed Britain into a corner and I don't know how they get out of it. Is the Parliament capable of reaching a majority on any Brexit plan? I'm a no-dealer but can they achieve that? What are they going to end up with: an EU Brexit plan?

No the parliament cannot agree on a single plan. Most agree that leaving is inevitable but Boris, Farage et al want to bust out reneging on an agreement leaving Britain in a totally uncertain future.

Farage is controlling this process.

All parties have some leavers and some remainers, it goes across party. The ones who crossed the floor today are people conservatives who want to leave but without a deal.

Thr uncertainty of an upcoming election isn't necessarily going to break on party lines, which is why Farage looms very large. I still think Boris has done a deal with him and this is mostly theatre. The parliament taking control today was was expected, as will be the vote tomorrow. What isn't certain is what happens from there and whether Boris ''hold me back or I will force an election'' bluff works for him.

Boris is banking on the opposition parties not wanting Corbun as an interim PM following a no confidence vote with promise of election, and not getting the 67% vote required to call a clean election. I think he hopes to stagger through to October 31 with no deal and just fall out of the EU with no deal keeping Farage onside.

Procedural last night, the Commons debated and passed the Bill to leave Europe and hold an election before Oct 31 ONLY if a deal has been signed.

It now goes to Lords where it will very likely become law and await Boris next move.
