when Hang sat 3 wide the trip and smashed them in the Toowoomba guineas last year it would have run through a brick wall. Hang then had a  couple more starts for currie with no result and then transferred to Nolan who has managed a couple of placings. 

At least with him gone it will make things a lot fairer for other toowoomba trainers

Currie case shows flaws in Queensland system

The Queensland system of racing justice is flawed if Toowoomba trainer Ben Currie hasn’t faced a stewards inquiry on 28 charges from April last year.

The trainer has been making a living off the industry for more than 10 months, while making every attempt to avoid answering charges. His case is still the subject of a Supreme Court challenge later in the month.

In the meantime, every other trainer has to question whether they are on an even playing field when racing against Currie-trained horses.

Currie had another seven charges, including instructing the use of an electric device - a jigger - added to his rap sheet on Friday. Asked to a show cause hearing on Monday, Currie’s lawyer wanted two weeks to prepare.

It has become a joke. The Darren Weir case was dealt with with two weeks in Victoria, which gives some indication as to how slow the wheels of justice turn in Queensland.

Currie cannot train in NSW because of the serious nature of charges, a ruling which was made last year.

Wisdom has been chasing me but I've always outrun it!

Have not heard of any QCAT ruling on a stay. But the job of Ross Barnett is on the line in this case. Currie has exposed flaws in the handling of this case from the start and it’s been a Keystone Cops effort. Curries legal team is winning a real David v Goliath battle, when it should be cut and dried. If he’s guilty kick him out.
Gambling has brought our family closer together. We had to move to a smaller house.

Thats the limit of info I have.  Tweet says 5 business days after the internal review.  Currie still has time to bring up the half centruy of charges.  Only 11 to go.

This is a great example of why Queensland Racing should fall under the jurisdiction of the Attorney General.

By what has been reported on Racenet, the case against him is all over the place and any lawyer representing Queensland Racing, is not up to the task of advising the stewards, as the show cause should have only happened when the evidence supported the decision.

In Victoria Weir was caught red handed with the devices, and there were phone records and alledged vision of the use taking place, so the evidence backed up the show cause hearing.

But Queensland is not alone here. I see that Maclean is asking to take over Weir's Warnambool operation, and in the current climate, he might be successful.

If Maclean gets the go ahead here then I give up!

The interpretation of slang language is likely to be a central issue when trainer Ben Currie defends animal cruelty charges in future hearings.

Currie was in the Queensland Civil and Administrative Tribunal on Thursday when he was successful in a stay on a suspension handed down by stewards on Monday.

Scott McLeod QC, for the Queensland Racing Integrity Commission, said Currie faced seven serious charges based on a series of text messages uncovered after his phone was confiscated by investigators.

“There are harping charges, a shock-wave charge and a bleeding charge,” he said.

Currie’s counsel Jim Murdoch QC said there was no direct evidence to link the texts with any offence.

“(For instance) harped up could have a multitude of benign meanings,” Murdoch said.

He said no jiggers or devices had been found at Currie’s stables or anywhere else even though the stables had been raided, were under covert observation and CCTV had been taken from them.

Murdoch said shock-wave treatment could be a perfectly legal application to a horse for injuries as long as administered in a legal timeline.

One of the charges against Currie involved selling a horse that had bled without telling stewards it had bled.

But Murdoch said if the horse had a bleed from one nostril that was something not reportable to stewards.

McLeod disagreed with some of Murdoch’s interpretations leading QCAT Member Robert Olding to say he could not make a decision without hearing expert evidence.

Neither side thought it was necessary to call expert witnesses on the meanings in the stay application.

He's right. A horse being harped could mean anything. They were probably playing soothing music for them. Same as tubing on race day could mean he went for a morning surf.

Of course the race clubs have the option to invoke AR50, ''They retain the right to refuse any nominations and do not need to provide a reason for such decision'' AR50 is seldom used, in fact I can't recall this being invoked in the 50 years I have spent in this game.....but bring it on.
