Stewards charged Currie and several of his staff after raiding his Toowoomba stables on April 7. He was originally charged with 31 offences but three of those were dropped and the remaining 28 charges were to be heard at a reconvened inquiry on August 13. That inquiry was adjourned to allow further particulars of the charges to be given to Currie's lawyers. In a short statement on Thursday, the Queensland Racing Integrity Commission said the reconvened stewards inquiry had been further delayed until the outcome of a Supreme Court hearing. A Supreme Court application for judicial review by Currie is set down for September 28. Currie's lawyers will seek the review on the grounds stewards have not properly exercised their right of discretion to allow Currie to have legal representation at his hearing. His lawyers to date have not been allowed into the previous inquiry hearings. It will also be further argued QRIC has failed to provide proper particulars relating to some charges including how Currie was alleged to have influenced or been responsible for any breach of rules. Thirdly, Currie's lawyers will allege he has been denied justice by QRIC refusing to release to them transcripts of a hearing in which some of Currie's employees were questioned under oath by a barrister. QRIC Commissioner Ross Barnett said the Commission would make no comment at this time. BEN CURRIE HEARING DEFERRED FOR MONTHSThursday 27 September, 2018 Mark Oberhardt A stewards hearing into 28 charges against Toowoomba trainer Ben Currie may not be heard for at least six months. Currie's lawyers have lodged a Supreme Court review application seeking orders involving the charges which arise from a raid on his stables at Toowoomba on April 7. The application which mainly involves particulars of the stewards case has to be resolved before an inquiry can resume. The application was to be heard in the Supreme Court in Brisbane on Thursday but was delisted. A Queensland Racing Integrity Commission spokesperson confirmed the stewards hearing was now unlikely to go ahead until next year. "Mr Currie's legal representatives and the Queensland Racing Integrity Commission have today agreed on dates for the filing of materials and the Supreme Court hearing will commence on February 22," the spokesperson said. "The stewards inquiry cannot be resumed until the Supreme Court matter has been determined." It is usual for applications to the court to take up to a month to get a decision which means the stewards inquiry may not start until at least April. Currie's lawyer Jim Murdoch QC said he could not comment until after legal matters had been resolved. |

I assume that means he can train during this period.
If the defendant is the one who choses to prolong the case, then they should be stood down until the matter is finalised, at least until he supreme court stage has been completed, a bit like being stood down until a investigation takes place with police officers who have allegations against them. |

Toowoomba trainer Ben Currie is facing a fresh inquiry regarding prohibited substances detected in three of his horses on raceday. The Queensland Racing Integrity Commission stewards confirmed on Wednesday that Currie, who is still to face 28 charges relating to a raid of his stable in April, is set to face an inquiry scheduled to start on January 14, 2019. The horses named in the alleged breach are: Wicked Trilogy (Kilcoy, December 2, 2017), Shakira (Toowoomba, January 28, 2018) and Karaharaga (Rockhampton, July 6, 2018). Each of Wicked Trilogy and Shakira won the races in question, while Kaharanga finished eighth at Rockhampton. |

Great to see SA Racing are equally as weak as QLD Racing by halving the sentences of a couple of cheats. Surely it can’t be that hard to set a precedent.

Linghi, this trainer is a serial culprit, and QRIC have the option to stand him down on the basis that, his “stay of proceedings” or “injunction” is qualified by, “no further rule breaches”. Stand him and the other rascals down immediately. Birchley is another one who should be watching proceedings closely. |

There are many protected species out there and memories are seemingly shorter for some trainers indiscretions ....
Eg. no matter which way you look at it, the Snowden’s case was Raceday treatment which penalty is not a fine but suspension/DQ.... if that were a B12 injection they’d have gotten a 3 yr mandatory |

"No matter which way you look at it"? Glad you aren't involved in our legal system Skippy. Stewards looked at it and took certain things like stable systems, past issues etc into account - as they should.
Has any trainer been suspended for bute errors in recent times? Fines have been the standard. It was an error made by a stable which is as clean as they come afaik.
"Evidence during the inquiry on Wednesday established California Concord was unintentionally given the substance in the lead-up to the race. ARFL General Manager John Keledjian tolds the hearing “that the high level of phenylbutazone detected in the sample was consistent with the administration of phenylbutazone within 24 hours of the sample being collected”. Stewards established the Snowdens treatment records on the day before the race showed “horses stabled next to California Concord were treated with 10ml of phenylbutazone paste” and California Concord “had recently been relocated to that stable complex and treatment records show it was not scheduled to receive phenylbutazone on 28 September 2018”. "Toowoomba trainer Ben Currie is to have a fourth charge involving a prohibited substance swab added to the three he is to answer at an inquiry. Queensland Racing Integrity Commission stewards informed Curre’s legal representative of the charge on Friday afternoon. Last month, QRIC told Currie he would face three charges at an inquiry on January 14. In a media release QRIC said the fourth charge against Currie would allege he brought winner Dreamscope to race at Toowoomba on September 16 with prohibited substances in its system. The previous alleged prohibited substance breaches relate to Wicked Trilogy on December 2, 2017 at Kilcoy, Shakira on January 28 at Toowoomba and Karaharaga on July 6 at Rockhampton. QRIC has not identified the substance involved. All four charges will be heard together and are unrelated to other charges Currie is facing.
