ROBERT Smerdon could have amassed more than $3 million in prizemoney with doped winners as the Racing Appeals and Disciplinary Board considers imposing a $100,000 fine on the rogue trainer.

Disqualified for life as the Aquanita doping ring mastermind, Smerdon has been convicted of being party to 115 counts relating to race-day treatment using sodium bicarbonate “top-ups”.

Of the 115 counts, the Herald Sun has identified 54 occasions where winning horses appear to have been treated by float driver Greg Nelligan on Smerdon’s orders.

Nelligan and his wife Denise also have been disqualified for life.

Five others — trainers Stuart Webb (four years), Tony Vasil (three years), Trent Pennuto (two years), Liam Birchley (one year) and stablehand Danny Garland (one year) — have also been sidelined, subject to possible appeal.

Smerdon’s lawyer Tim McHenry described Racing Victoria’s push for a fine as “completely premature”.

He argued the demand for the fine — and the prospect of civil court action against Smerdon — could have a “potentially disastrous financial outcome” for the veteran trainer.

Text messages exchanges between Nelligan and Smerdon reveal hundreds of races were targeted by the pair and, more broadly, the so-called “circle of trust”.

Suspect victories have been uncovered in Group 1 level contests at Flemington and Rosehill to country maidens.

In total, successful Smerdon runners suspected of being illegally treated between June 2010 and June 2016 earned $3,460,877.

McHenry last week claimed Smerdon owns no property and, at 63, is not yet able to access superannuation funds.

Trainers generally earn 10 per cent of the winner’s purse.

Birchley said under the Aquanita Racing model trainers were paid a weekly wage and shared 50 per cent of the profits with the company.

The now defunct Aquanita Racing owned 49 per cent of Smerdon Training Services — and Smerdon sat on the Aquanita board.

RAD Board chairman Judge John Bowman described the Aquanita doping scheme as the darkest and longest chapter in Australian racing.

The board is yet to reach a position on the possibility of disqualifying horses thought to have been doped.

Mosheen (Vinery Stakes and Australian Guineas), Black And Bent (Galleywood and Houlahan Hurdles) and Politeness (Myer Classic) are among top-liners whose successes might have due to performance-enhancing substances.

Other possibly tainted wins involved Shewan (Herbert Power Stakes) and Fontein Ruby (Caulfield Classic).

I can not see how a civil action would succeed.

The only hard evidence that you could use would be text messages, and even then a judge would want an extra piece of evidence, to back those messages up.

Obviously no drugs were detected and it was only a whistle blower who notified the racing authorities to do the random investigation that caught Nelligan.

Big difference between proving something at a tribunal, to a court of law or civil court.

Probably why we have not heard anything form Victoria Police. Yet.
Remember, it might take intelligence to be smart , but it takes experience to be wise

Civil court the burden of proof is on the balance of probabilities,which is substantially lower than beyond reasonable doubt that the Police are required to prove in a criminal case.

The bigger question is if he owns no property,what is a judgement worth?

Interesting post by Schlink because a number of horses have the same owners who were or are big bettors. One died from cancer: PHIL Sly. He backed a horse on a Wednesday to win $250000 through Smerdons commission agents. The horse was backed at 6/1. It won easily on Saturday at the Sandown Cup meeting. 100% reliable info. 100%

Adolphius, Phil was a big better at times, and had money to back it up. He would be more of an innocent party in this, in my opinion. Other big betters, who are closely linked to Aquinita would not be so innocent,

Ultimately, it would be Nerrim Lodge themselves, who MUST take civil action against Smerdon. They've claimed no knowledge of the systematic doping, yet there business has been severely damaged as a result. But, I doubt that's going to happen for obvious reasons....

This is the comment that makes the entire goings on more seriously corrupt..

Doesn't pass the pub test ..most likely living in property owned by wife so as no one can touch them ..would be interesting to hear when title ownership changes were made if any . What about the stash of cash ..better change the $50 and $100 notes  as new noted coming soon would want to be done by tax man for undeclared income

You're a sniper with a one-track mind who rarely sticks around for debate or discussion on anything.  The list of your disappointments is long. Your occasional reasonable point,invariably gets lost amongst the inevitable dross that suffocates it,and all those that read it.

You will find that with a change of attitude, you could even lose your current talent of clearing a room when you enter.
