Former Queensland CFMEU president David Hanna’s trial heard he asked staff to burn files, which were then dumped in tip

A former Queensland union boss has been convicted of destroying tonnes of documentsthat could have been evidence in a royal commission.

David Arthur Hanna, a former Queensland president of the CFMEU, dumped dozens of boxes of documents in April 2014 after being told the trade union royal commission would focus on the union.

On Monday a Brisbane district court jury found him guilty of a single count of destroying, concealing or mutilating documents after seven hours of deliberations.

He was handed a nine-month jail sentence but won’t spend time in prison as he can be released after paying a $500 good behaviour bond that he will be subject to for the next two years.

Hanna instructed colleagues to take dozens of boxes of documents from the union’s Brisbane office to his home, where he asked staff to try to burn files, his week-long trial heard.

When they failed to burn, the boxes were collected in a truck and dumped at a tip near Ipswich.

One witness testified Hanna had asked him to cover up CCTV cameras at the union’s office while he loaded the boxes into a horse float.

Another told the court Hanna asked her to then get rid of what she believed was a receipt for the cost of “burying” documents with an excavator.

The measures were an attempt by Hanna to keep the disposal secret, prosecutors argued.

Hanna’s defence lawyer claimed his actions were part of an innocent office clean-up.

Asset prices in WA’s lucrative rock lobster fishing industry have plummeted and could halve within months according to operators blaming moves by the State Government to seize a chunk of the fishery.

After Fisheries Minister Dave Kelly this month shocked the industry by announcing he would take a 17 per cent share of WA’s rock lobster catch, industry figures have reported pot price falls of about 25 per cent.

The reports came as it emerged Mr Kelly had used a Chinese-owned company to donate $40,000 of rock lobsters to a charity Christmas lunch over the past two years.

The gifts to the Mission Australia event were made by Kailis Bros, which was given an exemption by the minister to take 450kg of rock lobsters above its annual allowable catch in both years to facilitate the donation.

Parliamentary records show the decision by Mr Kelly was taken against the advice of the industry, which warned that exemptions would set a dangerous precedent for the integrity of the fishery’s tightly controlled limits.

Acting Fisheries Minister Roger Cook said Mr Kelly approached the Western Rock Lobster Council and the Geraldton Fishermen’s Co-operative to supply the rock lobsters.

“We felt this was an opportunity for the Western rock lobster industry to give back to the WA community and to help spread some Christmas joy,” Mr Cook said. “This request was refused by WRLC and GFC.

“The lunch was a great success and the lobster was appreciated by those less fortunate in the Perth community that attended the lunch.”

Prominent Lancelin-based fisherman Peter Prideaux lashed out at Mr Kelly’s intervention, saying it had a “chilling” effect on the $500 million industry’s confidence.

As a result, he said investment had fallen as fishers waited to see what happened with Mr Kelly’s plans.

According to several fishers, prices for pots had fallen by as much as one-quarter and there were fears they would fall further, hurting many families who bought the assets as nest eggs for their superannuation.

“Little families have been buying back in,” Mr Prideaux said.

“It is a total breach of ministerial duties and trust.”

Mr Cook said: “I’m surprised at the willingness of senior people in the industry to talk down its future.

“All the indicators are that demand will grow.”

Union boss John Setka charged after Boxing Day argument at his home


Prominent union boss John Setka has been charged after police were called to reports of an argument at his home on Boxing Day.

The Victorian secretary of the Construction, Forestry, Maritime and Energy Union will face court next week after police were called to an address in West Footscray just after Christmas.

"Police attended a West Footscray address following reports of an argument on Boxing Day," a police spokeswoman said.

"A 54-year-old man was arrested and charged with a court order offence. He was bailed and will appear in Melbourne Magistrates’ Court on January 9."


Court listings show Mr Setka will face court for a mention on the morning of January 9, and lists the Westgate Family Violence Investigation Unit as the prosecuting agency for the matter.

Mr Setka is married to lawyer Emma Walters and has three children.

He released a statement on social media shortly after the news emerged.

"For well over thirty years now I have dedicated my life to the health and well-being of construction workers and their families, and on more occasions than I care to remember, my passion and bluntness has landed me in the headlines and not always for the right reasons," he wrote.

"Over the last three years my wife Emma and my children David, Kate and Johnny have suffered immensely from the ongoing political and ideological attacks on myself as a union leader, with the possibility of losing their husband and father to a prison sentence. This has been an extremely enormous strain on our family unit and it has taken its toll on each of us as individuals.

"I ask that while family members are seeking to recover from this tumultuous period in their personal lives that they are given the privacy to do so."

In May 2018, prosecutors dropped blackmail charges against Mr Setka and his deputy, Shaun Reardon, which Mr Setka described as a politically motivated witch-hunt intended to criminalise trade union activity.

He came under fire late last year after posting a photo of two of his children holding a sign telling the government's Australian Building and Construction Commission to "go get fuc#ed".
