Bryce Stanaway has failed in his application for a stay of proceedings against his three-year disqualification on misconduct-related charges.

The Victoria Civil and Administrative Tribunal (VCAT) on Friday rejected Stanaway’s application for the penalty to be stayed ahead of a VCAT review in his case, which is not expected to be held before the end of the season.

Stanaway, 62, had been disqualified for three years by the Victorian Racing Tribunal on seven misconduct-related charges arising from an incident concerning injured horse he trained at the Bendigo racecourse on October 17 of 2020.

After his mare Moorabool broke down during a race that day, Stanaway ran onto the track and abused RV officials as they were treating the horse as well as threaten a veterinarian and then later became abusive to other attendants to the horse.

As part of his application, Stanaway’s representative Daniel Cash told VCAT senior member Anna Dea that Stanaway is in "dire financial straits" as he was receiving no income from training fees or from prizemoney earned.

Senior member Dea said the decision to reject the application for a stay of proceedings was not taken lightly in view of Stanaway’s financial position but that none of the material in front of her could lead to a different judgement.

Stanaway’s last runners were at Sandown on February 2.

The case is listed for an administrative mention before VCAT on April 13.

Bryce Stanaway will make a last-ditch attempt to save his training career at the Victorian Civil and Administrative Tribunal on Friday.

Brian McMahon, a lawyer representing the veteran horseman, will apply for a stay of proceedings that would allow Stanaway to continue training despite a three-year disqualification, which was dished out by the Victorian Racing Tribunal for a string of charges earlier this month.

The charges stem from incidents at the Bendigo races and Stanaway’s Torquay stables in October 2020 and relate specifically to misconduct, threatening and abusive language directed to industry officials, failing to obtain veterinary treatment as directed and conduct prejudicial to the image of racing.

It is understood the application for the stay of proceedings will be made on the grounds that Stanaway was denied procedural fairness during the hearings and that the Victorian Racing Tribunal failed to consider any mitigating factors when handing down their judgement.

If granted the stay of proceedings, McMahon indicated that the trainer will appeal the severity of the three-year disqualification.

A GoFundMe page established to raise funds for Stanaway’s legal costs has passed $4000, with donations from several well-known racing figures.

Some interesting comments from Anita Stanaway on her Twitter.
No stewards or officials from the day lodged a complaint, it was only after Bryce lodged his complaint that the stewards took issue with the charge. Bryce was trying to stop the vet from using a stallion chain on the injured agitated mare. A recipe for disaster!

Sounds like pure spite to me. 
 Really, look at the tennis players, Nick Curious threw a tantrum, hit a kid in the face with a slammed ball, and zilch, nada, nothing. 
Gave him a racket and continued blithely on his arrogant way.

Trainers who stick up for the welfare of their horses need a medal, not a 3 year outage.

The Victorian Racing Tribunal disqualified trainer Bryce Stanaway for three years on Thursday in relation to a series of misconduct charges.

Stanaway had previously been found guilty of eight charges relating to an incident involving his injured horse Moorabool at the Bendigo races in October 2020 and then three days later at his stables at Torquay.

The charges relate to the manner in which the trainer spoke to stewards, as well as a raceday vet and a barrier attendant, although Stanaway maintains his actions were motivated by a desire to ensure the welfare of his horse.

At Thursday’s penalty hearing, the Tribunal tabled written submissions from both parties and heard short statements from the legal counsel for both Stanaway and Racing Victoria.

Justin Hooper, acting for the stewards, said Stanaway should serve at least a five year disqualification – three years for the charges relating to the raceday incident and a further two years for the charges relating to his conduct at his stables.

“The stewards submit that the offending is so serious that Mr Stanaway should serve no less than a three year disqualification for his conduct at that race meeting, in respect of each of those charges,” Hooper said.

The stewards submit that the offending is s serious that Mr Stanaway should serve a two year disqualification for the conduct at his stables.

“Those periods should be served cumulatively for the reasons set out in the submissions, they relate to separate incidents and separate conduct.

“Ultimately the stewards submit that the Tribunal should disqualify Mr Stanaway for at least five years.

“Mr Stanaway, as an experienced trainer of that length of time (40 years), should’ve had a very good understanding of his privileges and responsibilities as a licensed trainer.

“Mr Stanaway should know better.

“There is no reliable evidence before this Tribunal that this manner of explosive conduct and inability to listen to those in authority will not happen again.”

Stanaway was represented by the former Chair of Racing Australia, Frances Nelson QC, who urged the Tribunal to hand down a penalty “proportionate to the circumstances of the trainer”.

She pointed to Stanaway’s clean record during his lengthy career.

The three-person Tribunal, headed by John Bowman, is expected to release a detailed summary of the penalty including the reasons for the decision in the coming days.

I don't want to hijack the thread , but as you mentions Kate, I see Bernard Saundry who was the boss when her bullying took place is on his way back to Oz from NZ where he has held sway for a few years and carnage has ensued.......I hope Kate gets supreme justice for what they put her through, not only financial compensation.
