I understand she lives close to Kilmore & has been training at Seymour for most of the duration of this mess.

Sorry, I meant in the years before she was suspended from Kilmore. Years and years of abuse, obviously something had gone on as she said her horses were being hit in the training chute before the horse broke down incident. Why would you stay around to cop it all the time?

he Racing Appeals and Disciplinary Board has scheduled the following hearings in relation to this matter.

Directions Hearing

A directions hearing between the parties and the Chairman of the Racing Appeals and Disciplinary Board will take place at 11.00am on Tuesday, 17 January 2017.

Hearing of the charge under AR 8D

The RAD Board will hear the charge laid by the stewards against trainer Kate Goodrich at 9.30am on Monday, 23 January 2017.

Ms Goodrich has been charged with a breach of AR 8D which states that:

AR 8D:  Any licensed person who, whilst the stewards are exercising the powers vested in them by Rule BB or carrying out their duties, refuses to obey any reasonable direction of stewards or obstructs, hinders or delays stewards in exercising such powers or carrying out their duties, or incites any other person or persons to obstruct, hinder or delay stewards from exercising such powers, or carrying out their duties, or does not act to prevent any other person or persons on the premises from so doing, may be penalised.

The particulars of the charge are that on 12 December 2016 members of Racing Victoria’s Compliance Assurance Team attended Ms Goodrich’s licensed training premises for the purpose of conducting a stable inspection.  Following the arrival of the stewards, Ms Goodrich:

         a. did not allow the Stewards to conduct a routine race day stable inspection at Ms Goodrich’s              licensed training premises;

         b. did not allow the Stewards to examine the horse Street Stalker (entered to run in Race 6 at          Kilmore that day);

         c. refused to obey a reasonable direction from Stipendiary Steward Mr Melville to allow an                inspection of the horse.

Ms Goodrich’s conduct was in contravention of AR 8D, as she:

        a. obstructed and/or hindered the Stewards from exercising the powers vested in them by AR 88 and/or carrying out their duties; and/or

        b. refused to obey reasonable directions of the Stewards where those directions were made in the exercise of powers under AR 8D and/or in the carrying out of their duties.

Goodrich saga to head to Supreme Court

The long running saga around bullied and banned racehorse trainer Kate Goodrich is likely to take another dramatic turn next month.
Armed with a new legal team headed by Finlay Davis from Davis De La Rue and Associates, Goodrich will now commence a proceeding in the Supreme Court of Victoria.
It follows what she calls a lack of progress in any meaningful mediation with Racing Victoria as recommended by RADB head Judge Bowman at a January directions hearing.
That followed charges against Goodrich that effectively banned her horses from starting firstly in Victoria then mandated also by Racing New South Wales.
The RADB is to hear the charges in March after she refused inspection of a horse at her Kilmore property on December 12 last year by the RV Compliance Assurance Team.
Davis, for Goodrich, told G1X.com.au, that he would seek adjournment of that hearing to lodge a statement of claim in the Supreme Court seeking damages against Racing Victoria and Kilmore Racing Club
“Given that, racing Victoria are not interested in a formal mediation we will issue a statement of claim seeking damages for the conduct and actions of both executives the Kilmore Racing Club and Racing Victoria over a number of years that have caused financial ruin, prevents Kate from training and which conduct has caused her current medical condition.”
“We say this conduct have been collusive, deliberate, reckless and negligent and Kate deserves compensated.”
Davis said action against racing officials was not out of the question in respect to “malicious prosecution or abuse of process in respect to certain executives at racing Victoria and Kilmore Racing Club.”
It is understood the independent report that was commissioned by Racing Victoria that found Goodrich had been “bullied” under the terms of the Fair Work Act would underpin any claim.
The FBIS International report, which has been kept secret by RV, also found that the decision by the Kilmore Turf Club to ban Goodrich from training there as “flawed and unjustified”.
Goodrich remains defiant as the saga enters another year but buoyed by her new legal team.
“It is all so overwhelming and now it seems they want to continue to use all of the industry money to run me out of the game I love,” she said.
“That is why we’ve requested an adjournment of the RADB hearing. While my allegations against racing officials remain unresolved I believe the system of Integrity in Victorian racing is compromised.
“For a fair hearing and outcome at the RADB it is important that they have a full understanding of the circumstances that have led to my mistrust of Racing Victoria and its integrity department and why I can’t operate under this system.”
“We have given racing every chance to sort this out, it’s so sad it has come to this but as I continue fighting it doesn’t change the fact I have to give up what I love doing,” she said.
Racing Victoria provided a short statement to G1X on the latest developments in the Goodrich case
“As the matter remains before the RAD Board it would be inappropriate for us to comment at this time,” said spokesperson Shaun Kelly.

Emotions laid bare at Goodrich inquiry

If anyone needed a deeper understanding of bullied trainer Kate Goodrich they only needed to be at Friday’s Racing Appeals Disciplinary Board (RADB) hearing.

 

In a highly emotional three hours, Goodrich pleaded guilty to obstructing the Racing Victoria compliance assurance team (CAT) at a routine stable visit on December 12 last year under rule 8(d). RV Stewards have refused her nominations since, a move followed in New South Wales.

 

In what was described as a “complex matter’ and a first before the RADB, Judge Bowman issued a three month suspension against the charge but suspended that for 12 months, effectively opening the way for Goodrich to have runners again.

 

The board changed an original intention of disqualification to suspension but RV stewards through counsel James Ogilvy, sought to submit the ban on nominations under AR50 remain.

 

This was immediately rejected by Judge Bowman who said the issue was now resolved and that AR50 had no further effect.

 

But Goodrich has no horses in work and must decide if she wishes to train in Victoria or anywhere as her long dispute with RV and the Kilmore Racing Club, where she once trained continues.

 

An independent RV report founded she had been “bullied” as a trainer at Kilmore where reasons for a ban imposed on her training there were “flawed and unjustified”.

 

Goodrich will be in the Supreme Court in late May with civil action against RV continue, and although despite much mediation, no solution has been achieved between the parties.

 

But it was the RADB hearing of the charge itself that almost hauntingly played out the state of mind of Goodrich and her mistrust of the RV Integrity team.

 

After an RV video recording of the December stable visit was played into evidence, Goodrich’s barrister Ragu Appudurai was able to play a recording from Goodrich’s own mobile phone of the event.

 

This was a recording left going after the CAT had left the property and all that can be heard is Goodrich uncontrollably sobbing and crying for about four minutes until she is heard to say “when is this all going to end”.

 

The hearing was later adjourned when Goodrich burst into tears when asked to provide her position on allowing RV staff onto her property in the future under the rules to complete a stable inspection. (It was later agreed that Goodrich would not attend a stable inspection though responsibility on her horses remained with the trainer).

 

Their own CAT supplied vision showed Simon Quinter and Rhys Melville entering the Goodrich property, that she shares with her partner Jon Hassall, and seeking to inspect Street Stalker, who running at Kilmore that day.

 

Goodrich said they had indicated via a letter to then RV CEO Bernard Saundry that they did not trust RV stewards and would not allow them onto her property.

 

“How can I trust you as employee of Racing Victoria you are going to do right thing and if you don’t who do I go to?” Goodrich is seen saying to the CAT.

 

“Every single allegation I have made has been ignored. I can’t believe I’ve been put in this position. You are destroying my life, my livelihood

 

“You all talk about welfare, look at the state I’m in right now. I don’t want you coming on my property while this situation is not resolved.

 

She went on to say in the CAT presence: “This is just so disgusting”.

 

 Both Goodrich and Hassell are seen saying they had no issue with the CAT inspecting the horse but wanted a member of Victorian Police present.

 

Ogilvy for RV said “no trainer was able to contract out of stable inspections by stewards” under the rules of racing.

 

“The purpose of the visit on December 12 was not as a result of a tip off, it was a routine stable inspection, at least seven others were conducted on that day, from largest stable in area to the smallest,” he said.

 

Ogilvy acknowledged this was a ‘complex matter” and accepted Goodrich’s state of mind was respected in relation to her mistrust of RV.

 

“Stewards do not accept Ms Goodrich’s state of mind is the cause or is justified by their conduct. That is a matter of dispute and on-going dispute,” Ogilvy said.

 

He said stewards acted independently of the RV board and “do not act on the behest of CEO, who doesn't tell them to allow police to attend stable inspection.”

 

Appudurai said the plying of Goodrich’s audio after the CAT had left her property clearly explained her state of mind.

 

“What she has already endured is more than any penalty you would have done in any case. She has had several years unrelenting pressure,” he said.

 

Judge Bowman said the board had already taken into account the three months “served” under the current nominations ban but any breach of rule 8 (d) in the next 12 months would see the three month suspension revisited.

 

The first hour of Friday's hearing was closed as sections of the controversial FBIS Independent Report commissioned by RV was discussed. As it remains only a "draft report" Judge Bowman agreed that much if the evidence was untested and possibly defamatory.

More dictatorial madness from RVL a few months ago but this FB post in response to Michelles' suspension.
For the record this person is a track riding personal friend.


"So a certain person has returned a positive urine sample showing a prescribed drug (basically pharmaceutical meth) and is looking at 4 / 6 weeks suspension, yet I get 3+ months for "refusing" to give a sample, which in actual fact I did give a sample, (which came back clean) the only thing I refused was two stewards (untrained medically) two stand in front of me and "watch" whist I peed in a jar!! I also offered for them to take my blood because I was uncomfortable, embarrassed and felt intimidated to have to do this after recently giving birth and just had a medical procedure done which was backed with documents from my gp and specialist!!!"
Wisdom has been chasing me but I've always outrun it!

The RV Stewards seem to have no common sense.

Why are they performing the tests anyway ?

It should be done by a contracted government licensed company as I am in my workplace.

Far too much sense in that for racing authorities djebel. That would also facilitate female to female supervision. 

Harder to cover up incompetence if you have a third umpire though. Contractors would have to be trained in standover tactics and have the common sense parts of their brains reprogrammed.

Don't get me wrong, if the stewards in question are the local equivalent of Sir Les Patterson, by all means, tell em to get stuffed. Otherwise, why would a steward expect to be held up by either embarrassment or medical clearance?

On the first point, testing should be expected. If you're not ok with it, then you cannot ride professionally.

On the second, would it not be ok to assume that, given the job, all is well with the area in question?

surely they can give you some basic privacy or at least provide a female to supervise the female being tested. Having a much older man watch you go to the toilet is wrong on so many levels, I hope the male stewards are not watching all these young female jockeys like that.

Not sure if being medically trained is a requirement but surely the same sex person to take the sample would be mandatory.

Of course random testing of track riders is necessary & it's expected by them as they've signed up for it but for heavens' sake, invasion of basic privacy shouldn't be an expectation.
However, disagree with their methods or those conducting collection & you're immediately suspended, clean or otherwise Angry Restriction of trade surely?
Guilty of ?????????????? protecting your privacy?

It's a WADA requirement that the 'chaperone' (doping control officer) that views the urine sample collection is the same gender as the individual they are testing and a minor or someone with an intellectual impairment say, has a third party present

Wasn't all that long ago you could buy a prosthetic with a concealed reservoir & fake the act, primarily due to natural instinct being to look away, or just cop a quick glance.

Controls are much tighter these days. It's not a job for the squeamish.
