Victorian barristers take silk road to smash 'bamboo ceiling'

It has taken 200 years, but Australia now has its first barristers of Chinese descent to be appointed senior counsel.

William Lye and Cam Truong were among 25 advocates who were made silk in Victoria last week, and hope their career milestones will convince other Chinese and Asian lawyers to follow suit.

"When I came to the bar (in 2005), there was only William as a Chinese barrister," said Mr Truong.

"It was seen as not a safe course to take as an Asian law student.

"There may have been cultural issues of not wanting to be involved in disputes and litigation, but I didn't have that mindset...

"I think people, are now seeing it as a legitimate career path, where as before they would choose accounting or commerce, or stay on a more cautious career path within commercial law."

Both men have Chinese parents. Mr Truong, 43, was born one month before the fall of Saigon in 1975 and came to Australia aged three. Three times, his family tried to cross the Arafura Sea without success before Malcolm Fraser's Coalition government chartered a plane and brought it to Australia with a load of Vietnamese refugees.

His brother is Huy Truong, a venture capitalist who co-founded gift website wishlist.com.au with his wife and sisters. 

"Huy is the AFR's go-to refugee," jokes Cam.

Mr Lye, 55, who was born in Malaysia, has been at the Bar since 1988. He says the only barrister of Chinese descent before him was William Ah Ket, who signed the bar roll in 1904.

"Our appointments would be the first since the independent Bar was established in the late 1800s," Mr Lye said.

"It is also auspicious because 2018 marks 200 years since the first Chinese settled in Australia – Mak Sai Ying."

He says there are no judges in the superior courts across Australia that have Chinese descent and that the only judicial officer is Victorian magistrate Charles Tan.

Mr Lye recognises the term bamboo ceiling but says: "I'd say it's a concrete ceiling."

Of the 6,500 barristers in Australia, he estimates only 120 have an Asian background, with most having been born here.

"They have a better chance now and even more so now that they can see a pathway; that others have broken the 'bamboo ceiling'.

"I never considered myself other than Australian but the fact I wasn't born here and I didn't speak with an Australian accent are things that may have held me back, I don't know.

"But I think today, with the second and third generations of Australians born to parents of Asian or Chinese descent, it is different."

Both men have broad commercial practices, with Mr Lye specialising in cross-border transactions and Mr Truong in trade practices law and commercial law disputes.

Mr Truong says about 20-30 people of Asian background are in the junior ranks of the bar in Victoria, with even more coming through.

"That's happened in the last two to five years so the composition is certainly changing," he says.

"I share the Chief Justice's view that all levels of the profession should reflect the society in which we live – and we know for a fact that one quarter of Melbourne is born overseas – a significant part of that is from Asia."

Mr Lye says "it's often the case that people can be stereotyped".

"All we are asking – for those who are culturally diverse – is to be given a chance."

Premier backs Labor MP under fire for overlooking ties to China groups

A Western Australian Labor MP is under fire for failing to declare his ties to organisations promoting the Chinese government's foreign policy interests, but has won support from Premier Mark McGowan and senior ministers.Upper House MP Pierre Yang, who has travelled with Mr McGowan on official trips to China, told The Australian he overlooked his membership to the Northeast China Federation Inc and the Association of Great China when making personal interest disclosures to Parliament.

The newspaper reported these organisations support China's aggressive military posture in the South China Sea and its controversial 'Belt and Road' infrastructure scheme.

But Mr McGowan said he would be backing Mr Yang.Pierre Yang is a valued and respected member of my team, who I have the utmost respect for," he said.

"His proud service for this country, serving as a captain of the Australian Army Reserve, speaks volumes of him.

"Pierre is one of the most genuine, nicest and considerate people I know and he has my full confidence."

Mr Yang said he was a member of "multiple organisations in the community" and had updated his parliamentary returns since becoming aware of the oversight.

"I have always strived to be an active participant in the community," he said.

"I also overlooked my membership of the William Langford Community House. I recently joined the Royal Australian Army Ordinance Corps Association WA."

Opposition government accountability spokesman Tjorn Sibma said Mr Yang's explanation he "overlooked" his membership of two associations which promote the foreign policy interests of the Chinese Government to be "highly improbable".

"All incoming members of Parliament are briefed by the clerks about their disclosure responsibilities," he said.

"Mr Yang is an intelligent man and would have clearly understood his obligation to disclose his memberships.

"Furthermore, as the Government’s Whip in the Legislative Council he is very familiar with the standing orders.

"Mr Yang’s failure to disclose his interests speaks volumes about the McGowan Government’s contempt for Parliament, and the increasingly poor standards of government openness, transparency and accountability."

But senior Labor ministers were defending Mr Yang over his ties to the China-linked organisations.

Asian Engagement Minister Bill Johnston said Cabinet had been briefed by security agencies on a number of occasions and no issue regarding any member of Parliament had been raised.

He said Mr Yang had been called up to active service by the Australian Defence Force last year.

"Clearly, if there was a question in Commonwealth agencies' minds, they probably would respond to that," he said.

"It's also very important to understand that WA has a very close business relationship, there's many organisations that have extensive operations in China; if every business that had extensive operations in China was called into question, there would be no organisations in WA that wouldn't be touched by that."

Tourism Minister Paul Papalia said Mr Yang was an excellent member of Parliament and it was "pretty handy having a Chinese-born member of our government when we're advocating for direct flights from China and tourism growth from China".

It is understood Mr Yang has also been encouraging Labor membership in branches in Gosnells and Thornlie.

When asked about his involvement in Labor's branches the South Metropolitan Region MP said he was proud of his activity in the party.

"It is important that all Australians of every social and cultural persuasion have an equal voice in the political process," he said.

Labor MP Pierre Yang forced to quit pro-China groups

A Labor MP has been forced to resign from two organisations in Perth amid claims they are fronts for the Chinese Government and its ruling Communist Party.

Pierre Yang, the MP for South Metropolitan and Labor’s Upper House Whip, failed to reveal his links to the pro-China groups in two disclosure documents filed in State Parliament.

He claims it was an “oversight” and has denied being involved in actively promoting the interests of China, where he spent the first 15 years of his life in the north-eastern city of Harbin.

But the Opposition is demanding the MP make a statement in Parliament about his ties to the Perth-based North-East China Federation and the Association of Great China.The 35-year-old is understood to have been part of the AGC since 2011, and the NECF since 2016, shortly after winning Labor preselection.A photo shows Mr Yang was present at the Perth signing of an agreement that supported the Communist Party’s infamous United Front Work Department — which actively tries to influence Chinese people overseas.

“I was invited to join some members of the North-East China Federation for a meal at a suburban Chinese restaurant, which was arranged for two people visiting Perth from China,” Mr Yang said.

“No one told me beforehand that any agreement or document would be signed at the dinner. I do recall that something was signed in the evening, and yes I was there.

“I did not pay it much attention, as it did not involve me.”

Mr Yang, an Australian Army Reserve captain, told The West Australian yesterday he understood there were concerns about the United Front and its aims, but he said he did not realise the significance of the agreement that was signed until last week.

“I honestly overlooked my membership in North-East China Federation and Association of Great China,” he said. “I declared these associations after I realised my oversight, but have as of this morning resigned from both.”

He disclosed his membership of the Chung Wah Association and the Chinese Chamber of Commerce.

Opposition Leader Mike Nahan said it was not plausible that Mr Yang overlooked his role in both associations. “It’s OK to overlook a bowling club, but not one of those associations with clear links to the Chinese Government,” Dr Nahan said. “Mr Yang will have to discuss in Parliament the nature and depth of those associations.”WA Labor said it was aware of the MP’s links to one of the associations before last year’s election, but Mr Yang should have updated his interests when he joined the NECF. “It is the responsibility of the preselected candidate to update the party of any notable changes,” party secretary Matt Dixon said.

Premier Mark McGowan, who travelled to China with Mr Yang last year, backed the MP. “His proud service for this country ... speaks volumes of him,” he said. “Pierre is one of the most genuine, nicest and considerate people I know and he has my full confidence.”

Premier Mark McGowan gives himself top marks so far

Like a shopper ticking off the grocery list, Mark McGowan rattled off his Government’s achievements this year.

The GST war was won. Metronet is under way. WA has signed up to the National Disability Insurance Scheme. Plastic bags have been banned. The country’s first methamphetamine addiction jail was opened. Matagarup Bridge to the new stadium was built. Taxi industry reforms passed Parliament.

The list of 22 Premier’s picks went on and on before he stopped to consider what the successes meant for him as WA’s leader.“Politics is about achievement and the thing I like most about being Premier is doing good things and getting things done,” he said. “It’s not about photos in the paper or being well-received.”

But it helps.

What has also given the Premier and WA Labor a leg-up this year is the state of the Liberal Party across the country.But the Premier has faced skirmishes along the way. Some are far from over.

The decision to lift his party’s moratorium on hydraulic gas extraction — known as fracking — in some parts of WA went against a motion of Labor’s State executive. It also irked some Labor MPs, who wanted a Statewide ban.

“We are a mining and gas State,” the Premier said. “Gas produces less than half the emissions of other fuel sour-ces. If China used more gas their emissions would go down. You have to look at the facts rather than just saying no.”

He said his party had committed to a scientific study of fracking and that once the report came back with evidence it could be done safely it had to be acknowledged.

Despite pressure from celebrity activists, such as singers Missy Higgins and John Butler, Mr McGowan was hopeful the fracking debate would not become the next James Price Point with protests and division among Aboriginal groups in the Pilbara.

Canada blocks Chinese takeover of Aecon over national security concerns

Aecon’s takeover by overseas investment and financing arm of ChinaCommunications Construction Co Ltd was scheduled to close in February. But this was delayed after Canada extended a national security review.

Aecon, which has helped build Canadian landmarks including the CN Tower and the Saint Lawrence Seaway, saw its shares tumble 15% to a 10-month low on the Toronto stock exchange on Thursday.

The Canadian government has now ordered CCCC International Holding Ltd not to implement the proposed investment to protect national security, Navdeep Bains, the Canadian innovation minister said in a statement on Wednesday.“Our government is open to international investment that creates jobs and increases prosperity, but not at the expense of national security,” Bains said.

Justin Trudeau, the Canadian prime minister, said earlier his government would closely monitor security issues when it decided whether to allow the deal, examining the implications for intellectual property protections.

China’s foreign ministry said it hoped Canada could “abandon its prejudices” and provide a level playing field for Chinese enterprises in response to a question about the Aecon deal.

“In principle, China always opposes the politicization of this kind of trade and investment activity and we oppose the mistaken method of carrying out political interference on the basis of so-called national security reasons,” a ministry spokesman, Lu Kang, said on Thursday.

Aecon said it was disappointed with the government’s decision and was no longer pursuing a sale process.

“We believe … uncertainty around the company’s future strategic direction, particularly with a CEO search under way, is likely to weigh on share prices substantially,” AltaCorp Capital analyst Chris Murray said.

An executive from CCCC’s investor relations team in Beijing told Reuters the company had yet to receive relevant documents from the Canadian government.Ottawa’s move comes as Canada is in exploratory trade talks with China as the country seeks to diversify its export markets.

Chinese interests in overseas assets has worried governments elsewhere such as in Denmark, whose officials have expressed concern over Greenland courting Chinese firms, including CCCC, to expand three airports.

The Committee on Foreign Investment in the United States (CFIUS), which scrutinizes foreign purchases of US assets to protect national security interests, has also been tightening scrutiny of Chinese companies’ acquisitions of American firms.

Earlier this month, the Chinese conglomerate HNA Group dropped its bid for most of SkyBridge Capital.

In January, Ant Financial’s plan to acquire US money transfer company MoneyGram International collapsed after CFIUS rejected it over national security concerns.

Huawei's CFO arrested in Canada, faces extradition to United States

New York (CNN Business)The chief financial officer of Chinese tech giant Huawei has been arrested in Canada. She faces extradition to the United States.

Meng Wanzhou, also known as Sabrina Meng and Cathy Meng, was apprehended in Vancouver on December 1, according to Canadian Justice Department spokesman Ian McLeod. In addition to her role as CFO, Meng serves as deputy chairwoman of Huawei's board. She's the daughter of Huawei founder Ren Zhengfei.
Meng "is sought for extradition by the United States, and a bail hearing has been set for Friday," McLeod said in a statement, which was first reported by The Globe and Mail.
    McLeod said the Canadian Justice Department can't share details of the case. Meng was granted a publication ban after a judge agreed to bar both police and prosecutors from

    Huawei CFO arrested in Canada on suspicion of violating US sanctions

    Meng Wanzhou was arrested on 1 December in Vancouver and faces extradition to the USCanada has arrested Huawei’s global chief financial officer in Vancouver, where she is facing extradition to the US in a move likely to exacerbate tensions between the US and China.

    Meng Wanzhou, one of the vice-chairs on the Chinese technology company’s board and the daughter of the company founder Ren Zhengfei, was arrested on 1 December and a court hearing has been set for Friday, according to Canada’s department of justice. The arrest is reportedly related to violations of US sanctions.In a statement, the department confirmed Meng had been arrested and was facing extradition. “As there is a publication ban in effect, we cannot provide any further detail at this time. The ban was sought by Ms. Meng,” it said.

    US authorities have been investigating Huawei since at least 2016 for allegedly shipping US-origin products to Iran and other countries in violation of US export and sanctions laws, sources told Reuters in April.

    Huawei, one of the world’s largest makers of telecommunications network equipment, said in a statement that Meng had been “temporarily detained” and faced unspecified allegations” in the Eastern district of New York.

    The company said it had complied with “all applicable laws and regulations where it operates,” including sanction laws.

    “There has been very little information provided to Huawei on the specific allegations. Huawei is not aware of any misconduct by Ms. Meng,” Guo Ping, rotating CEO of the company said in a statement posted on his Wechat account on Thursday.

    “The company believes the Canadian and US legal systems will ultimately reach a just conclusion,” he said.The arrest comes days after president Donald Trump and president Xi Jinping held a meeting in Argentina where they agreed to steps to resolve the ongoing trade war between the world’s two largest economies. US stock futures tumbled, followed by Asian markets, after news of the arrest broke.China’s embassy in Canada on Thursday said it resolutely opposes the arrest of Meng, and had lodged “stern representations” to the US and Canada. The embassy said such actions had “seriously harmed the human rights” of Meng.

    “We will closely follow … and take all measures to resolutely protect the legitimate rights and interests of Chinese citizens,” the embassy said in a statement.

    US stock futures and Asian shares tumbled after Meng’s arrest. The news came as Washington and Beijing begin three months of negotiations aimed at de-escalating their bruising trade war, which is adding to global investors’ worries over rising US interest rates and other risks to global economic growth.

    The S&P500 e-mini futures fell almost 25 at one point in thin Asian morning trade and were last were down 1.2%. Japan’s Nikkei slid 1.7% and Hong Kong’s Hang Seng dropped 2.1% while Shanghai shares dropped 0.9%.

    Meng served on the board of a Hong Kong-based Skycom tech, which has business in Iran, according to corporate filings seen by Reuters. In 2013, Reuters found that the company, which attempted to sell embargoed Hewlett-Packard computer equipment to Iran’s largest mobile-phone operator had closer ties to Huawei than was previously known.

    Huawei – one of the world’s largest telecommunications equipment and services providers – has been tightly constrained in the US by worries it could undermine local competitors and that its phones and networking equipment, used widely in other countries, could provide Beijing with avenues for espionage.On Wednesday, BT, the UK telecoms group, confirmed it was in the process of removing Huawei equipment from the key parts of its 3G and 4G networks, as part of an existing internal policy not to have the Chinese firm at the centre of its infrastructure.

    Governments in New Zealand and Australia have also moved to block the use of Huawei’s equipment in future 5G networks. Earlier this week, the head of the UK’s MI6 questioned the the company’s presence in critical telecoms infrastructure.

    “We need to decide the extent to which we are going to be comfortable with Chinese ownership of these technologies and these platforms in an environment where some of our allies have taken quite a definite position,” said Alex Younger.

    Head of MI6 had questioned Chinese firm’s involvement in UK telecoms infrastructure

    BT has confirmed it is removing Huawei equipment from key areas of its 4G network as concerns are raised about the Chinese firm’s presence in critical telecoms infrastructure.

    Governments in the USNew Zealand and Australia have already moved to block the use of Huawei’s equipment as part of the future rollout of 5G networks. Earlier this week the head of MI6 also suggested the UK needed to decide if it was “comfortable” with Chinese ownership of the technology being used.

    In a statement, the UK telecoms group has confirmed it is in the process of removing Huawei equipment from the key parts of its 3G and 4G networks to meet an existing internal policy not to have the Chinese firm at the centre of its infrastructure.
